Terms and Conditions

Important: These Terms and Conditions apply to every reservation and stay at the rental cottage located at 360 Parnell Cove, Grand Marais, Manitoba, referred to in these Terms and Conditions as the “Rental.”

“Owner” means the owner or authorized operator of the Rental.

“Primary Guest” means the person who makes the reservation.

“Guest” means the Primary Guest and every other person who enters or uses the Rental during the reservation.

“Property” means the cottage, driveway, parking areas, decks, hot tub, yard, beach area, furnishings, equipment and any other areas or amenities provided with the Rental.

By making a reservation, submitting payment, checking in or entering the Property, the Primary Guest confirms that they have read, understood and agreed to these Terms and Conditions. The Primary Guest is responsible for ensuring that all other Guests comply with them.

1. Nature of the Stay

The Rental is provided solely as temporary vacation and recreational accommodation.

The reservation grants Guests a temporary licence to occupy the Rental for the confirmed reservation period. It does not create a residential tenancy, permanent residence, leasehold interest or other interest in the Property.

Guests may not use the Rental as their principal residence, receive mail at the Property, register a business at the Property or represent that they have any ongoing right to occupy the Property.

2. Primary Guest

The Primary Guest must:

  • Be at least 18 years of age and legally capable of entering into this agreement.
  • Provide accurate contact and identification information when requested.
  • Be present at the Rental throughout the reservation unless the Owner approves otherwise in writing.
  • Be responsible for all Guests, visitors, charges, damages and breaches associated with the reservation.
  • Provide the Owner with the names or number of all occupants when requested.

A reservation may not be transferred, assigned, resold or sublet without the Owner’s prior written consent.

3. Reservation and Payment

A reservation is not confirmed until the Owner has accepted the reservation and received all required payments or payment authorizations.

Rates, taxes, cleaning charges, deposits and other applicable charges will be identified during the booking process or in the reservation confirmation.

The Owner may require:

  • Full or partial payment at the time of booking.
  • A security deposit.
  • A credit card pre-authorization.
  • Authorization to charge the payment method used for the reservation for amounts owing under these Terms and Conditions.

The Guest is responsible for reviewing the reservation confirmation and promptly reporting any errors.

4. Cancellations and Changes

The cancellation and refund policy displayed during the booking process or included in the reservation confirmation forms part of these Terms and Conditions.

Unless the Owner agrees otherwise in writing:

  • Changes to reservation dates are subject to availability and any applicable rate difference.
  • Reducing the number of nights after confirmation does not necessarily result in a refund.
  • Failure to arrive, late arrival or early departure does not entitle the Guest to a refund.
  • Weather conditions, insects, smoke from regional wildfires, beach conditions, lake conditions or changes to personal travel plans do not entitle the Guest to a refund.
  • Non-refundable third-party booking or payment-processing charges may be deducted from any refund where those charges cannot be recovered by the Owner.

The Owner strongly recommends that Guests obtain travel and cancellation insurance.

5. Check-In and Check-Out

Unless different times are stated in the reservation confirmation:

  • Check-in is after 4:00 p.m.
  • Check-out is no later than 11:00 a.m.

Early check-in and late check-out require prior written approval.

Guests must not enter the Property before the approved check-in time. At check-out, all Guests and their belongings must be removed from the Property.

An unauthorized late check-out may result in additional charges, including additional cleaning costs and losses caused by delaying the next reservation.

6. Occupancy and Visitors

The maximum occupancy is the number stated in the listing or reservation confirmation. Children and infants count toward the maximum occupancy unless the Owner expressly states otherwise.

Only registered Guests may stay overnight. Day visitors require the prior approval of the Owner and may not cause the permitted occupancy to be exceeded.

The following are prohibited without the Owner’s prior written approval:

  • Parties, receptions, weddings or other events.
  • Large gatherings.
  • Commercial activities.
  • Admission fees or ticketed activities.
  • Tents, recreational vehicles or additional sleeping accommodations.
  • Photo or video productions.
  • Any activity that creates excessive traffic, noise or disturbance.

The Owner may immediately terminate a stay if unauthorized occupants, visitors, parties or events are discovered.

7. Smoking and Vaping

Smoking and vaping are permitted only in the designated smoking area that is clearly marked by a sign.

Smoking and vaping are prohibited everywhere else on the Property, including:

  • Inside the Rental.
  • On decks, steps and patios.
  • In or near the hot tub area.
  • In the yard, driveway and parking areas outside the designated smoking area.
  • On the beach or shoreline area.
  • Near doors, windows, air intakes or ventilation equipment.

This rule applies to cigarettes, cigars, pipes, cannabis, vaping devices, electronic cigarettes and all other smoked or vapour-producing substances.

Guests using the designated smoking area must use the receptacle provided, fully extinguish all smoking materials, keep the area clean and never discard cigarette butts or other materials on the ground.

The Owner may temporarily prohibit all outdoor smoking or vaping during a fire ban, extreme fire risk, unsafe weather condition or other safety concern. Guests must follow any posted or written direction from the Owner.

Guests may not burn incense, sage, candles or any other substance inside the Rental.

Evidence of smoking or vaping outside the designated smoking area may result in:

  • Immediate termination of the stay without a refund.
  • Specialized smoke and odour remediation.
  • Cleaning or replacement of carpets, furniture, bedding, curtains and other materials.
  • Charges for inspection and contractor services.
  • Charges for rental income lost while remediation is completed.

The Primary Guest is responsible for all reasonable costs resulting from a violation of this section.

8. Noise and Neighbourhood Conduct

Guests must respect neighbouring properties and the surrounding community.

Quiet hours are from 10:00 p.m. until 8:00 a.m. During quiet hours, outdoor noise must be kept to a minimum.

At all times, Guests must avoid:

  • Excessive music, shouting or amplified sound.
  • Disorderly, threatening or offensive conduct.
  • Trespassing on neighbouring property.
  • Blocking roads, driveways or access routes.
  • Outdoor lighting or activity that unreasonably disturbs others.
  • Any violation of applicable noise or nuisance requirements.

Complaints from neighbours, police attendance or repeated noise violations may result in immediate termination of the stay without a refund.

9. Prohibited Activities

Guests must not use the Property for:

  • Illegal activity.
  • Trafficking or production of controlled substances.
  • Dangerous, reckless or destructive conduct.
  • Prostitution or other commercial sexual activity.
  • Gambling operations.
  • Storage of hazardous, explosive or flammable materials.
  • Discharging firearms, air guns, bows or other weapons.
  • Fireworks or firecrackers.
  • Hunting or trapping.
  • Any activity that could invalidate the Owner’s insurance or place the Property or another person at risk.

Lawful alcohol consumption is permitted only by persons of legal drinking age and must be responsible. Intoxication does not excuse damage, unsafe conduct or a breach of these Terms and Conditions.

10. Children and Supervision

The Rental is intended to accommodate families. It has direct access to Lake Winnipeg and includes areas where children could be injured without proper supervision.

Children and minors must be supervised by a responsible adult at all times, particularly:

  • Near the lake or shoreline.
  • On the beach.
  • In or near the hot tub.
  • On decks and stairs.
  • Around fires or cooking equipment.
  • Around vehicles, watercraft or recreational equipment.

The Owner does not provide childcare or supervision.

11. Beach and Lake Safety

There is no lifeguard on duty at the Property or the nearby beach.

Swimming, wading, boating, fishing, walking on the shoreline and all other water-related activities are undertaken at the Guest’s own risk.

Lake Winnipeg conditions can change quickly. Guests are responsible for assessing weather, water, wave, current and shoreline conditions before entering or approaching the water.

Guests must:

  • Closely supervise children and inexperienced swimmers.
  • Use properly fitted personal flotation devices when appropriate.
  • Avoid entering the water during dangerous weather or water conditions.
  • Never swim or operate watercraft while impaired.
  • Follow all posted warnings and applicable laws.
  • Avoid damaging vegetation, shoreline features or neighbouring property.

The Owner does not guarantee water quality, water temperature, beach width, absence of debris, absence of algae or safe swimming conditions.

Winter ice must never be assumed to be safe. Guests must not enter onto lake ice from the Property unless the Owner has expressly authorized the activity and the Guest has independently confirmed that conditions are safe.

12. Hot Tub Rules

Use of the hot tub is at the Guest’s own risk and is subject to all posted instructions.

Guests must:

  • Shower before entering.
  • Keep the hot tub covered when it is not in use.
  • Keep the water and surrounding area clean.
  • Ensure minors are continuously supervised by a responsible adult.
  • Observe the posted maximum occupancy.
  • Use only plastic or non-breakable drink containers.
  • Immediately report cloudy water, unusual odours, equipment problems or unsafe conditions.
  • Follow any additional instructions provided by the Owner.

The following are prohibited:

  • Glass containers.
  • Smoking or vaping in or near the hot tub area.
  • Food in the hot tub.
  • Oils, bubble bath, soaps, bath products or foreign substances.
  • Diving, jumping, horseplay or unsafe conduct.
  • Tampering with controls, pumps, filters, chemicals or equipment.
  • Use by an intoxicated person.
  • Use by an unattended minor.
  • Use by anyone with a condition for which hot-tub exposure is medically inadvisable.

Infants and children who cannot safely keep their heads above the water may not use the hot tub.

Pregnant persons and persons with heart conditions, blood-pressure concerns, circulatory conditions or other health concerns should obtain appropriate medical advice before using the hot tub.

Guests are responsible for reasonable costs caused by misuse, contamination, draining, damage or the need for extraordinary cleaning and refilling.

13. Boats and Watercraft

A boat or other motorized watercraft is not included with the Rental unless it is expressly included in the reservation confirmation or a separate written agreement.

Guests must not operate, move, access or permit anyone else to use any motorized watercraft located at the Property without the Owner’s prior written authorization.

Where watercraft use is separately authorized, the Guest may be required to:

  • Sign a separate rental and liability agreement.
  • Provide proof of identity and legally required operator qualifications.
  • Pay an additional rental fee and security deposit.
  • Complete an equipment orientation.
  • Wear an approved personal flotation device.
  • Follow all boating laws and safety instructions.
  • Accept responsibility for fuel, damage, towing, fines and rescue costs.

Unauthorized use of any watercraft is a material breach of these Terms and Conditions.

14. Pets and Animals

Pets are not permitted unless the Owner has approved the animal in writing before check-in.

Where a pet is approved, the Primary Guest remains responsible for:

  • Keeping the pet under control.
  • Preventing excessive barking or disturbance.
  • Removing all animal waste.
  • Keeping animals off furniture and bedding where instructed.
  • Damage, stains, odours, fleas or additional cleaning.
  • Compliance with local animal-control requirements.

Guests must not leave an animal unattended unless it is safely crated and the Owner has approved the arrangement.

Nothing in this section limits a person’s rights concerning a service animal where accommodation is required by applicable law. Guests are encouraged to inform the Owner in advance so that suitable arrangements can be made.

15. Fires, Barbecues and Outdoor Cooking

Open flames, candles and indoor burning are prohibited.

Barbecues and approved outdoor fire areas may be used only:

  • In their designated locations.
  • In accordance with posted instructions.
  • Under continuous adult supervision.
  • When no fire ban or legal restriction is in effect.
  • After ensuring the fire or equipment is fully extinguished.

Guests must not move barbecues or fire equipment onto decks, near buildings or into enclosed spaces.

Fireworks, firecrackers, sky lanterns and similar devices are prohibited.

The Guest is responsible for all damage, firefighting costs, fines or other losses caused by an unauthorized or negligently managed fire.

16. Fire and Life-Safety Equipment

Guests must not disable, cover, remove or tamper with:

  • Smoke alarms.
  • Carbon-monoxide alarms.
  • Fire extinguishers.
  • Emergency lighting.
  • Locks.
  • Safety barriers.
  • Any other safety equipment.

The Owner must be notified immediately if any alarm sounds, appears defective or has a low battery.

Emergency exits, hallways, doors and access routes must remain unobstructed.

17. Plumbing and Wastewater

Guests must use plumbing fixtures responsibly.

Only human waste and a reasonable amount of toilet paper may be flushed. The following must not be flushed or placed into drains:

  • Wipes, including products labelled “flushable.”
  • Paper towel.
  • Feminine hygiene products.
  • Diapers.
  • Dental floss.
  • Grease, fats or cooking oil.
  • Food scraps.
  • Chemicals, solvents or paint.
  • Coffee grounds.
  • Any foreign object.

Guests are responsible for the reasonable cost of clearing blockages or repairing damage caused by improper use.

Leaks, backups, running toilets or other plumbing concerns must be reported immediately.

18. Property Care

Guests must treat the Rental, furnishings and equipment carefully.

Guests must not:

  • Move indoor furniture outside.
  • Rearrange heavy furniture without permission.
  • Remove any item from the Property.
  • Attach decorations using nails, screws, tape or adhesives that could cause damage.
  • Use towels or linens to clean vehicles, footwear, makeup, grease or outdoor equipment.
  • Tamper with appliances, mechanical systems or locked storage areas.
  • Charge an electric vehicle without the Owner’s approval.
  • Create excessive wear or leave the Property in an unusually dirty condition.
  • Access any area identified as private, locked or restricted.

Normal wear from responsible use is expected. Damage, missing items and extraordinary cleaning are not considered normal wear.

19. Cleaning and Check-Out Responsibilities

The regular cleaning charge covers ordinary cleaning between responsible stays. It does not cover excessive mess, damage or extraordinary cleaning.

Before departure, Guests must:

  • Place garbage and recycling in the designated locations.
  • Wash or load used dishes as instructed.
  • Remove food and personal belongings.
  • Return furniture and equipment to their original locations.
  • Leave used beds and towels as directed.
  • Close and lock windows and doors.
  • Turn off lights and small appliances.
  • Replace the hot-tub cover.
  • Return keys, remotes or access devices.
  • Report any damage or maintenance concern.

Additional charges may apply for excessive garbage, stained linens, food left throughout the Rental, unwashed dishes, pet waste, hot-tub contamination or other conditions requiring extraordinary labour or professional cleaning.

20. Damage, Missing Property and Additional Charges

The Primary Guest is financially responsible for damage or loss caused by any Guest or visitor, except for ordinary wear and tear.

Recoverable amounts may include the reasonable cost of:

  • Repairs and replacement.
  • Specialized cleaning or remediation.
  • Contractor call-outs.
  • Hot-tub cleaning, draining or repair.
  • Plumbing and drain service.
  • Replacing missing items, keys, remotes or access devices.
  • Restoring damaged landscaping or shoreline areas.
  • Removing abandoned property or excessive garbage.
  • Addressing smoke, cannabis, pet or other odours.
  • Insurance deductibles where applicable.
  • Lost rental income when damage prevents a subsequent confirmed stay.

Guests must report damage immediately. Promptly reporting accidental damage will be taken into consideration but does not eliminate responsibility for the loss.

The Owner may use photographs, video, invoices, contractor reports, receipts and inspection records to document a claim.

The Primary Guest authorizes the Owner to charge the payment method associated with the reservation for reasonable amounts owing under these Terms and Conditions. If the payment method cannot be charged, the Owner may issue an invoice, payable within seven days.

Upon request, the Owner will provide reasonable supporting information for a damage charge.

21. Reporting Problems

Guests must inspect the Rental shortly after arrival and promptly report any significant cleanliness, maintenance, safety or property concern.

The Guest must give the Owner a reasonable opportunity to investigate and correct a reported issue.

Guests must not arrange repairs, hire contractors, deduct expenses from amounts owing or alter the Property without the Owner’s prior authorization, except where immediate action is reasonably necessary to protect a person from imminent danger.

22. Owner Access

The Owner or the Owner’s representative may enter the Property when reasonably necessary to:

  • Respond to an emergency.
  • Protect persons or property.
  • Investigate a reported concern.
  • Complete urgent repairs.
  • Maintain the hot tub or essential systems.
  • Verify compliance after receiving a credible complaint.
  • Address a material breach of these Terms and Conditions.

Except in an emergency or urgent situation, the Owner will make reasonable efforts to contact the Primary Guest before entering.

23. Exterior Security and Safety Devices

The Property may use disclosed exterior cameras, doorbell cameras, noise-monitoring devices, alarms or other security equipment for safety, security and protection of the Property.

There will be no surveillance cameras in bedrooms, bathrooms or other private interior living areas.

Guests must not cover, disconnect, damage or tamper with any security or safety device.

24. Internet, Utilities and Amenities

Internet, television, streaming services, electricity, water, heating, air conditioning and other amenities are provided for convenience.

The Owner does not guarantee uninterrupted operation. Rural conditions, weather, utility failures, maintenance, service-provider outages or other circumstances beyond the Owner’s control may temporarily affect an amenity.

The Owner will make reasonable efforts to address significant problems but is not responsible for interruptions beyond the Owner’s reasonable control.

Guests must not use the internet connection for illegal activity, harassment, copyright infringement, unauthorized access, excessive commercial data use or any activity that could expose the Owner to liability.

25. Natural and Seasonal Conditions

The Property is located in a natural lakeside environment. Guests may encounter:

  • Mosquitoes, ticks and other insects.
  • Birds and wildlife.
  • Sand, pollen and vegetation.
  • Changing shoreline and beach conditions.
  • Wind, waves and rapidly changing weather.
  • Wildfire smoke or regional air-quality conditions.
  • Snow, ice, mud or uneven outdoor surfaces.
  • Temporary road or utility disruptions.

The presence of normal natural or seasonal conditions does not constitute a defect in the Rental.

Guests must not feed wildlife or leave food or garbage outdoors in a manner that attracts animals.

26. Vehicles and Parking

Vehicles may be parked only in designated areas and must not block roads, driveways, emergency access or neighbouring property.

The Owner is not responsible for theft, vandalism or damage to vehicles or their contents, except to the extent caused by the Owner’s negligence.

Trailers, recreational vehicles, boats and oversized vehicles require prior approval.

Electric vehicles may not be charged from the Rental’s electrical outlets without the Owner’s written approval.

27. Personal Property and Lost Items

Guests are responsible for securing their money, vehicles and personal belongings.

The Owner is not responsible for lost, stolen, forgotten or damaged personal property, except to the extent caused by the Owner’s negligence.

Lost property may be retained for up to 30 days. The Guest is responsible for shipping, handling and courier charges. Items that are unsafe, perishable, unsanitary or of negligible value may be disposed of immediately.

28. Assumption of Risk

Guests acknowledge that lakeside and recreational properties involve risks that may not exist in an ordinary residence.

These risks include, without limitation:

  • Swimming and water activities.
  • Changing lake and weather conditions.
  • Hot-tub use.
  • Slippery or uneven surfaces.
  • Decks and stairs.
  • Fire and cooking equipment.
  • Ice, snow and cold temperatures.
  • Wildlife and insects.
  • Use of recreational equipment.

Each Guest voluntarily assumes the ordinary and inherent risks associated with these activities and conditions and is responsible for choosing activities appropriate for their health, skill and experience.

29. Liability

To the fullest extent permitted by law, the Owner is not responsible for injury, illness, death, loss or damage arising from:

  • A Guest’s negligence, recklessness or misconduct.
  • A Guest’s breach of these Terms and Conditions.
  • An inherent or obvious recreational risk.
  • Failure to supervise a child or dependent person.
  • Use of the beach, lake, hot tub or recreational equipment.
  • Theft or loss of personal property.
  • Weather, wildlife or natural conditions.
  • Events beyond the Owner’s reasonable control.

Nothing in these Terms and Conditions excludes liability that cannot lawfully be excluded.

Guests should maintain appropriate travel, health, property and liability insurance for the duration of their stay.

30. Indemnification

The Primary Guest agrees to indemnify the Owner against reasonable claims, losses, fines, liabilities and expenses resulting from:

  • The negligence or intentional misconduct of a Guest or visitor.
  • Damage caused by a Guest or visitor.
  • A breach of these Terms and Conditions.
  • An unauthorized party, event, visitor, animal or activity.
  • A third-party claim arising from the conduct of a Guest or visitor.

This obligation does not apply to the extent that a loss was caused by the Owner’s negligence or intentional misconduct.

31. Termination of Stay

The Owner may terminate the reservation and require all Guests to leave immediately where there is:

  • Smoking or vaping outside the designated smoking area.
  • A party or unauthorized event.
  • Serious or repeated noise complaints.
  • Unauthorized occupants, visitors or animals.
  • Illegal activity.
  • Violence, threats or harassment.
  • Dangerous use of the Property or its amenities.
  • Intentional property damage.
  • Unauthorized watercraft use.
  • Interference with safety or security equipment.
  • Any other material breach of these Terms and Conditions.

Where a stay is terminated because of a Guest’s breach, the Guest is not entitled to a refund and remains responsible for resulting damage, cleaning, enforcement and other reasonable costs.

The Owner may contact police, emergency services or other authorities where appropriate.

32. Owner Cancellation and Unavailability

The Owner may cancel a reservation if the Property becomes unavailable or unsafe because of fire, flood, severe weather, utility failure, government order, major equipment failure, property damage or another circumstance beyond the Owner’s reasonable control.

Where the Owner cancels for such a reason before check-in, the Owner’s liability will normally be limited to refunding amounts paid directly to the Owner for the affected stay.

The Owner is not responsible for indirect expenses such as transportation, alternate accommodation, missed activities or other consequential losses.

33. Privacy

The Owner may collect and use reservation information, contact details, payment information, identification details and communications for purposes including:

  • Processing and administering reservations.
  • Providing access to the Rental.
  • Communicating with Guests.
  • Protecting the Property.
  • Processing payments and damage claims.
  • Meeting insurance, accounting and legal obligations.
  • Responding to emergencies or lawful requests.

Information will not be sold to third parties. It may be shared with payment processors, booking providers, cleaners, contractors, insurers, professional advisers or authorities where reasonably necessary.

34. Governing Law

These Terms and Conditions are governed by the laws of Manitoba and the applicable laws of Canada.

Any dispute that cannot be resolved informally will be submitted to a court or tribunal with jurisdiction in Manitoba, subject to any mandatory consumer-protection rights that apply.

35. General Provisions

If any part of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue to apply.

A failure by the Owner to enforce a provision on one occasion does not waive the Owner’s right to enforce it later.

Headings are included for convenience and do not limit the meaning of a provision.

Where these Terms and Conditions conflict with a written reservation confirmation or separate signed agreement, the more specific written term will apply.

These Terms and Conditions, the reservation confirmation, the applicable cancellation policy and any additional written rules provided before check-in constitute the agreement between the Owner and the Primary Guest.

36. Electronic Acceptance

Electronic acceptance has the same effect as a written signature.

By selecting an acceptance box, submitting a reservation, making payment, checking in or entering the Property, the Primary Guest confirms that:

  • They have read and accepted these Terms and Conditions.
  • They have authority to accept them on behalf of all Guests.
  • They will provide these rules to all Guests and visitors.
  • They accept financial responsibility for the reservation and the conduct of all Guests and visitors.

37. Contact and Emergencies

Questions, maintenance concerns and damage reports should be directed to the telephone number or email address provided in the reservation confirmation.

For a fire, medical emergency, crime in progress or other immediate danger, call 911.
